HYPERKART — CUSTOMER TERMS & CONDITIONS

Effective Date: 27 sept 2026Last Updated: 27 sept 2026 These Terms & Conditions ("Terms", "Terms and Conditions") govern your access to and use of the Hyperkart mobile application, website and related services ("Platform"). Please read these Terms carefully before using Hyperkart or placing an order. By registering for an account, accessing the Platform, placing an order, or otherwise using Hyperkart, you acknowledge that you have read, understood and agreed to these Terms. If you do not agree with these Terms, please do not use the Platform.

1. ABOUT HYPERKART

Hyperkart is a technology-enabled hyperlocal commerce platform that connects customers with participating local grocery stores, supermarkets, mini marts and mega marts ("Partner Stores"). Through Hyperkart, customers can:

  • Discover nearby Partner Stores
  • Browse available products
  • View product prices and information
  • Place grocery and other eligible orders
  • Make payments through available payment methods
  • Track orders
  • Receive orders at eligible delivery locations
  • Contact customer support
  • Provide ratings and feedback Hyperkart's objective is to help local stores serve their neighbourhood customers through digital commerce.

2. IMPORTANT UNDERSTANDING OF THE HYPERKART MODEL

Hyperkart operates as a technology and commerce platform connecting customers with participating Partner Stores. Unless specifically stated otherwise on the Platform: The Partner Store is responsible for the products sold through its store, including product availability, product quality, product description, pricing, packing and fulfilment. Hyperkart facilitates the technology, ordering experience, payment processing arrangements, customer communication and other platform services. Depending on the order and applicable service arrangement, delivery may be performed by:

  • the Partner Store's delivery personnel;
  • delivery personnel arranged through Hyperkart; or
  • another delivery service made available through the Platform. The applicable Partner Store and delivery arrangement may be displayed during the ordering process. Nothing in these Terms limits any rights or remedies available to you under applicable consumer protection law.

3. ELIGIBILITY

To use Hyperkart and place an order, you must:

  1. Be legally capable of entering into a binding contract under applicable law;
  2. Provide accurate and complete information;
  3. Have access to a valid mobile number;
  4. Provide a valid delivery address where required;
  5. Comply with these Terms and applicable laws. If you are using Hyperkart on behalf of another person, you confirm that you are authorised to do so.

1. CUSTOMER ACCOUNT

Certain features may require you to create an account. You are responsible for:

  • providing accurate information;
  • keeping your account information updated;
  • protecting OTPs and account credentials;
  • maintaining the security of your device;
  • ensuring that your account is not misused. You must not:
  • create an account using another person's identity;
  • impersonate another person;
  • provide false information;
  • share OTPs or authentication credentials;
  • use another person's account without authorisation. If you believe that your account has been compromised, you should contact Hyperkart support immediately.

5. LOCATION AND SERVICE AREA

Hyperkart is a hyperlocal platform. The Partner Store available to you may depend on:

  • your delivery location;
  • service radius;
  • store operating hours;
  • store availability;
  • delivery capacity;
  • inventory availability;
  • temporary operational conditions. Changing your delivery location may change the Partner Store, product availability, prices, offers, delivery charges and estimated delivery time. Hyperkart does not guarantee that the Platform or a particular Partner Store will be available at every location or at all times.

6. PRODUCT INFORMATION

Partner Stores are responsible for providing product information displayed on the Platform. Product information may include:

  • product name;
  • brand;
  • images;
  • description;
  • quantity;
  • weight;
  • unit;
  • MRP;
  • selling price;
  • applicable taxes;
  • availability;
  • applicable offers. We endeavour to keep product information accurate and current. However, product availability and certain product information may change because of:
  • inventory movement;
  • store-level changes;
  • supplier changes;
  • pricing updates;
  • product discontinuation;
  • technical delays;
  • other operational circumstances. Where there is a material discrepancy affecting your order, appropriate corrective action, cancellation or refund may be provided in accordance with applicable law and the applicable order/refund policy.

7. PRICES

The price displayed at the time you place your order will generally be the price applicable to that order, subject to the applicable terms shown at checkout. Your order total may include:

  • product price;
  • applicable taxes;
  • delivery fee;
  • handling or platform-related charges, where applicable;
  • applicable surge or special delivery charges, where lawfully applicable;
  • applicable discounts;
  • coupon benefits;
  • other charges disclosed before order confirmation. The final payable amount will be displayed before you confirm the order. MRP Where applicable, products will be offered in accordance with applicable pricing and legal requirements. A Partner Store must not use Hyperkart to misrepresent product pricing or applicable discounts.

8. PRODUCT AVAILABILITY

Products displayed on Hyperkart are subject to availability. A product may become unavailable between:

  • the time you view the product; and
  • the time the Partner Store processes your order. If an ordered product is unavailable, the applicable order may be:
  • partially fulfilled;
  • substituted, where a substitution option has been expressly provided or permitted;
  • cancelled in whole or in part; or
  • otherwise handled according to the applicable order/refund process. You will not be charged for an item that is cancelled before fulfilment where a refund is applicable.

9. FRESH, PERISHABLE AND WEIGHT-BASED PRODUCTS

Certain products available through Hyperkart may be:

  • fruits;
  • vegetables;
  • meat;
  • fish;
  • dairy;
  • eggs;
  • bakery products;
  • other fresh or perishable products. The actual weight, size, appearance and natural characteristics of fresh products may vary. For products sold by weight, the final quantity may differ within the applicable permitted range from the displayed or requested quantity. Where the final price depends on actual weight, the applicable amount will be calculated according to the applicable store/product pricing mechanism disclosed on the Platform. Natural variations in colour, size, shape or appearance of agricultural products will not necessarily constitute a product defect. This does not affect your rights where a product is spoiled, unsafe, materially defective, incorrectly supplied or otherwise not as represented.

10. PLACING AN ORDER

To place an order:

  1. Select the applicable Partner Store;
  2. Add products to your cart;
  3. Review your order;
  4. Select your delivery address;
  5. Select an available payment method;
  6. Review the total payable amount;
  7. Confirm the order. Once submitted, the order may be subject to acceptance and processing by the Partner Store. An order confirmation does not necessarily mean that every requested item is available. The order may be modified, partially fulfilled or cancelled where permitted by the applicable circumstances and law.

1. ORDER ACCEPTANCE

After you place an order, the Partner Store may process the order based on:

  • inventory availability;
  • store operating status;
  • delivery capacity;
  • product restrictions;
  • technical availability;
  • other legitimate operational requirements. If the order cannot be fulfilled, you will be informed through the Platform or another available communication method. Where a payment has already been collected for an unfulfilled order or item, the applicable amount will be refunded according to the applicable refund process.

12. ORDER CANCELLATION

You may cancel an order through the Platform where cancellation is available. Cancellation availability may depend on the stage of order processing. For example, cancellation may become unavailable after:

  • the store has started preparing the order;
  • products have been packed;
  • the order has been handed to delivery personnel; or
  • another cancellation restriction disclosed during checkout applies. Cancellation charges, if any, will be disclosed before or during the cancellation process where applicable. Hyperkart will not use cancellation restrictions to remove rights that cannot lawfully be excluded.

13. DELIVERY

Hyperkart aims to provide convenient and timely delivery. The estimated delivery time displayed in the app is an estimate, not a guaranteed delivery deadline, unless expressly stated otherwise. Delivery time may be affected by:

  • order volume;
  • store preparation time;
  • traffic;
  • weather;
  • road conditions;
  • delivery partner availability;
  • customer availability;
  • incorrect delivery information;
  • access restrictions;
  • unexpected operational events. You should provide a complete and accurate delivery address and any useful delivery instructions.

14. DELIVERY ADDRESS

You are responsible for ensuring that:

  • the delivery address is correct;
  • the address is accessible;
  • your phone number is reachable where required;
  • necessary access instructions are provided. If the delivery cannot be completed because of incorrect information or because the customer is unavailable after reasonable delivery attempts, the order may be treated according to the applicable cancellation/refund policy.

15. DELIVERY CONFIRMATION

Orders may be confirmed using one or more methods, including:

  • OTP;
  • delivery confirmation;
  • app confirmation;
  • customer acknowledgement;
  • other verification mechanisms. You should not share delivery OTPs with another person except the authorised delivery person at the time of delivery. If you receive an order without placing it, or believe an order was incorrectly marked as delivered, contact Hyperkart support promptly.

16. CASH ON DELIVERY

Where Cash on Delivery ("COD") is available:

  • COD availability may depend on location, store and order eligibility;
  • the applicable COD amount will be shown before order confirmation;
  • you must pay the amount due at delivery;
  • Hyperkart or the applicable delivery representative may require appropriate confirmation of payment. Repeated refusal or misuse of COD may result in restrictions on COD availability for your account, subject to applicable law and fair-use requirements.

17. ONLINE PAYMENTS

Hyperkart may support payment methods such as:

  • UPI;
  • debit cards;
  • credit cards;
  • net banking;
  • wallets;
  • other payment methods made available through supported payment providers. Payments may be processed through third-party payment service providers. Hyperkart does not ordinarily require you to provide your complete card credentials directly to Hyperkart where payment processing is handled by a payment provider. Payment provider terms may also apply.

18. PAYMENT FAILURE

If your payment fails:

  • the order may not be confirmed;
  • the amount may be temporarily held by the payment provider;
  • the amount may be automatically reversed;
  • you may need to retry the payment. If money has been deducted but the order is not successfully created, contact support with the relevant transaction details. Refund or reversal timing may depend on the payment provider and banking system.

19. REFUNDS

Refunds may arise because of:

  • cancelled orders;
  • unavailable products;
  • missing products;
  • incorrect products;
  • eligible damaged/spoiled products;
  • payment failures;
  • approved customer complaints;
  • duplicate payments;
  • other eligible circumstances. Refund eligibility and method will depend on the nature of the issue and applicable policy. Where applicable, refunds may be made to:
  • the original payment method;
  • the customer's bank account;
  • another permitted payment method;
  • another method required or permitted by applicable law. The separate Refund, Cancellation & Return Policy forms part of these Terms.

20. RETURNS AND PERISHABLE PRODUCTS

Because many Hyperkart products may be food, grocery or other perishable products, returns may not be available for every product. For eligible products, customers may be required to report issues within the period specified in the applicable Refund & Return Policy. For example, a complaint may be raised for:

  • wrong product;
  • missing product;
  • damaged product;
  • spoiled product;
  • materially defective product;
  • quantity discrepancy;
  • other eligible issue. Customers may be requested to provide photographs, videos, order details or other reasonable evidence to help investigate the complaint. Nothing in this clause limits mandatory consumer rights.

21. QUALITY COMPLAINTS

If you believe that a product is:

  • unsafe;
  • spoiled;
  • contaminated;
  • materially damaged;
  • materially different from what was ordered; please contact Hyperkart support as soon as possible. For food or other potentially unsafe products, you should stop consuming or using the product where appropriate and preserve the product/package for investigation where reasonably possible. Hyperkart may coordinate with the Partner Store and other relevant parties to investigate and resolve the issue.

22. OFFERS, COUPONS AND PROMOTIONS

Hyperkart may provide:

  • coupons;
  • discounts;
  • promotional offers;
  • free-delivery offers;
  • first-order offers;
  • category offers;
  • festive offers;
  • loyalty benefits;
  • other promotional benefits. Each offer may have specific conditions, including:
  • minimum order value;
  • eligible products;
  • eligible stores;
  • validity period;
  • usage limits;
  • customer eligibility;
  • payment-method restrictions;
  • geographic restrictions. The specific offer terms displayed at the time of use will apply. Unless expressly stated otherwise, promotional benefits cannot be exchanged for cash.

23. MISUSE OF OFFERS

Hyperkart may restrict or cancel promotional benefits where there is reasonable evidence of:

  • fraudulent activity;
  • multiple accounts created to obtain the same benefit;
  • coupon manipulation;
  • misuse of promotional codes;
  • automated or abnormal usage;
  • other material abuse of the promotional system. Any action will be taken subject to applicable law and the customer's legitimate rights.

24. CUSTOMER RESPONSIBILITIES

You agree to use Hyperkart responsibly and lawfully. You must not:

  • use the Platform for unlawful purposes;
  • place fraudulent orders;
  • provide false information;
  • abuse refunds;
  • repeatedly place and cancel fraudulent orders;
  • misuse promotional offers;
  • attempt to manipulate prices or order systems;
  • interfere with Platform security;
  • introduce malicious software;
  • scrape or copy Platform data without permission;
  • reverse engineer the application except where legally permitted;
  • impersonate another person;
  • harass Partner Store or delivery personnel;
  • misuse customer support;
  • use Hyperkart for resale unless expressly authorised.

25. CUSTOMER CONDUCT TOWARDS STORE AND DELIVERY PERSONNEL

Hyperkart expects customers to interact respectfully with Partner Store employees, delivery personnel and support representatives. Threatening, abusive, discriminatory or violent behaviour is not permitted. Where appropriate, Hyperkart may investigate complaints and take reasonable action, which may include restricting an account or specific services, subject to applicable law.

26. REVIEWS AND RATINGS

Customers may be permitted to rate:

  • products;
  • Partner Stores;
  • delivery experience;
  • overall service. Reviews should be genuine and based on your actual experience. You must not submit:
  • fake reviews;
  • reviews for compensation where disclosure is required and not made;
  • abusive content;
  • threats;
  • personal information of another person;
  • defamatory or unlawful content;
  • manipulated ratings. Hyperkart may moderate or remove content that violates applicable rules or law.

27. CUSTOMER-GENERATED CONTENT

If you submit photographs, reviews, comments, feedback or other content through Hyperkart, you grant Hyperkart a non-exclusive, royalty-free licence to use that content for operating, improving, moderating and promoting the Platform, subject to applicable law and the Privacy Policy. You remain responsible for ensuring that you have the right to submit such content.

28. INTELLECTUAL PROPERTY

The Hyperkart Platform, including:

  • logo;
  • branding;
  • application design;
  • software;
  • text;
  • graphics;
  • icons;
  • layouts;
  • interfaces;
  • databases;
  • original content; is owned by or licensed to Hyperkart and is protected under applicable intellectual property laws. You receive a limited, personal, non-exclusive and non-transferable right to use the Platform for its intended purpose. You may not copy, reproduce, distribute, modify, sell, license or commercially exploit Hyperkart intellectual property without prior written permission.

29. THIRD-PARTY SERVICES

Hyperkart may integrate with third-party services, including:

  • payment gateways;
  • mapping/location services;
  • communication providers;
  • analytics providers;
  • notification services;
  • authentication providers;
  • other technology providers. Your use of certain third-party services may also be governed by their respective terms and policies. Hyperkart is not responsible for independent failures of third-party systems beyond its reasonable control, subject to applicable law.

30. PRIVACY

Your use of Hyperkart is also governed by the Hyperkart Customer Privacy Policy. The Privacy Policy explains:

  • what information Hyperkart collects;
  • why information is collected;
  • how information is used;
  • how information may be shared;
  • data retention;
  • customer privacy choices and rights;
  • how to contact Hyperkart regarding privacy matters. Please read the Privacy Policy before using the Platform.

31. ACCOUNT SUSPENSION OR TERMINATION

Hyperkart may suspend or terminate an account where reasonably necessary because of:

  • fraud;
  • unlawful activity;
  • material breach of these Terms;
  • misuse of the Platform;
  • security threats;
  • repeated abuse of services;
  • other circumstances permitted by law. Where appropriate and legally required, Hyperkart may provide notice or an opportunity to address the issue. Account termination does not affect rights or obligations that have already accrued.

32. PLATFORM AVAILABILITY

Hyperkart aims to maintain a reliable service but does not guarantee that the Platform will always be:

  • available;
  • uninterrupted;
  • error-free;
  • free from technical problems. Temporary interruptions may occur because of:
  • maintenance;
  • upgrades;
  • network problems;
  • infrastructure failures;
  • security incidents;
  • third-party service failures;
  • circumstances beyond reasonable control.

33. FORCE MAJEURE

Hyperkart will not be responsible for delays or inability to perform caused by circumstances beyond reasonable control, including:

  • natural disasters;
  • severe weather;
  • floods;
  • fire;
  • epidemics or public-health emergencies;
  • strikes;
  • civil disturbances;
  • government restrictions;
  • transportation disruptions;
  • telecommunications failures;
  • major infrastructure failures;
  • other events beyond reasonable control. This clause does not exclude rights that cannot legally be excluded.

34. LIMITATION OF LIABILITY

To the extent permitted by applicable law, Hyperkart will not be liable for indirect, incidental, special or consequential losses arising solely from use of the Platform. However, nothing in these Terms excludes or restricts liability where such exclusion or restriction is prohibited by law, including applicable consumer protection rights. Hyperkart does not seek through these Terms to exclude liability for fraud, wilful misconduct, or other liability that cannot legally be excluded.

35. PARTNER STORE RESPONSIBILITY

For products supplied by Partner Stores, the Partner Store is responsible for matters relating to:

  • product availability;
  • product description;
  • product quality;
  • product packaging;
  • product legality;
  • applicable product-specific requirements;
  • fulfilment;
  • store-level pricing;
  • inventory. Hyperkart may assist in resolving customer complaints and coordinating with the Partner Store. This allocation of operational responsibility does not limit any rights you may have against Hyperkart or the Partner Store under applicable law.

36. FOOD AND PRODUCT SAFETY

Partner Stores are expected to comply with applicable laws and standards relevant to the products they sell. Where applicable, this may include requirements relating to:

  • food safety;
  • packaging;
  • labelling;
  • weights and measures;
  • expiry dates;
  • storage;
  • applicable licences and registrations. If you identify a potentially unsafe product, please report it to Hyperkart immediately.

37. AGE-RESTRICTED PRODUCTS

Certain products may be subject to legal age restrictions or other regulatory requirements. Hyperkart may:

  • restrict the availability of such products;
  • require age verification;
  • require identity verification;
  • refuse delivery where legally required. Customers must not attempt to purchase restricted products by providing false information.

38. MODIFICATION OF SERVICES

Hyperkart may modify, add or discontinue features, products or services from time to time. Where a material change affects an ongoing customer arrangement, Hyperkart may provide appropriate notice where required by law.

39. CHANGES TO THESE TERMS

Hyperkart may update these Terms from time to time. The updated version will be made available through the Platform. The "Last Updated" date will indicate when the Terms were most recently revised. Where required, Hyperkart will provide appropriate notice of material changes. Your continued use of the Platform after the effective date of updated Terms may constitute acceptance where legally permissible.

40. GRIEVANCE REDRESSAL

If you have a complaint relating to:

  • an order;
  • payment;
  • refund;
  • product;
  • delivery;
  • Partner Store;
  • account;
  • Platform service; you should first contact Hyperkart through the in-app support system or the designated grievance contact. 41. CONSUMER RIGHTS

Nothing in these Terms is intended to take away or restrict rights available to consumers under applicable law. Where any provision of these Terms conflicts with a mandatory legal requirement, the applicable law will prevail to the extent of that conflict. The Consumer Protection Act, 2019 applies to goods and services and provides the statutory consumer-protection framework in India. India Code

42. GOVERNING LAW

These Terms will be governed by the laws of India. Subject to applicable consumer protection laws and jurisdictional rights available to consumers, courts having appropriate jurisdiction over the relevant dispute may have jurisdiction. Nothing in this clause prevents a consumer from exercising a statutory right before a competent consumer forum or authority.

43. SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to remain in effect to the extent permitted by law.

44. ENTIRE AGREEMENT

These Terms, together with the following documents, form the principal terms governing your use of Hyperkart:

  • Privacy Policy
  • Refund & Cancellation Policy
  • applicable Offer/Coupon Terms
  • applicable Partner Store/product-specific terms
  • other policies displayed on the Platform If there is a conflict, the applicable mandatory law will prevail.
